State-backed Indemnity for General Practice (CNSGP)

On the 1st April 2019, the Government’s state-backed indemnity scheme for general practice (CNSGP) came into force. This new scheme provides cover for clinical negligence claims for all GPs, and all other staff working in delivering primary medical services under GMS, PMS and APMS contracts.
The scheme covers medical malpractice liabilities:
- incurred on or after 1 April 2019; and
- arising from an act (or an omission to act) on the part of a GP or any other person working in a general practice setting where that act (or omission):
- is connected to the diagnosis, care or treatment of a patient; and
- results in personal injury or loss to the patient.

The National Health Service (Clinical Negligence Scheme for General Practice) Regulations 2019
The scheme will not cover non-NHS or private work, attendance and support at inquests, support for regulatory investigations and proceedings as well as non-clinical liabilities.
In addition to the above, there is also a requirement for run-off cover to be purchased for pre-1st April 2019 liabilities where these are not covered by occurrence based protection.
